On Tuesday, U.S. District Judge Royce Lamberth blocked President Trump’s executive order halting taxpayer-funded transgender treatments in federal prisons, a move that exemplifies the overreach of activist judges and the relentless push to ignore biological truths.
The lawsuit, spearheaded by the American Civil Liberties Union (ACLU), was initially filed on behalf of just three prisoners who identify as transgender. Yet, Judge Lamberth granted the case class-action status, effectively opening the door for over one thousand federal inmates to demand taxpayer-funded hormones, clothing, and even surgeries. In his 36-page ruling, Lamberth audaciously claimed that the administration failed to justify why “gender-affirming care” should be treated differently from any other mental health intervention.
This ruling is a judicial travesty that ignores basic biology, common sense, and the safety of female prisoners. The Trump administration rightly responded, highlighting that putting biological men into women’s prisons endangers women, plain and simple. The White House statement unequivocally declares, “The decision allowing transgender women, aka MEN, in women’s prisons fundamentally makes women less safe and ignores the biological truth that there are only two genders. The Trump administration looks forward to ultimate victory on this issue in court,” according to Fox News.
President Trump’s executive order from January 20th explicitly declared the administration’s commitment to recognizing only two genders—male and female—as rooted in biological reality. It directed the Bureau of Prisons to ensure no federal funds would be expended on treatments aimed at conforming an inmate’s appearance to the opposite sex. This order wasn’t rooted in animosity toward transgender individuals, but rather in protecting taxpayer dollars and safeguarding women’s rights and safety in prison facilities.
Judge Lamberth’s ruling represents a troubling pattern of judicial activism aimed at thwarting the MAGA agenda. Time and again, unelected judges have stepped in to obstruct President Trump’s America First policies. Just last week, another federal judge intervened in the administration’s battle with Harvard University, temporarily blocking efforts by the Department of Homeland Security to freeze new international enrollments at the Ivy League school. Clearly, activist judges see themselves not as neutral arbiters of the law, but as ideological warriors determined to derail Trump’s efforts at every turn.
Taxpayers across America should be outraged that their hard-earned money is now being directed by judicial fiat toward elective, politically charged procedures for prisoners. At a time when hardworking families struggle to meet basic needs amid economic uncertainty—caused in large part by Biden-era inflation and failed policies—forcing taxpayers to foot the bill for inmate “gender affirmation” is an insult to common decency and fiscal responsibility.
Moreover, Judge Lamberth’s decision utterly disregards the safety of incarcerated women. Allowing men who “identify” as women into female prisons has already led to documented cases of assault, harassment, and trauma. Our prisons should prioritize security and rehabilitation, not radical social experiments that jeopardize vulnerable populations. The Trump administration rightly recognized this risk and took steps to protect innocent women. Now, thanks to judicial activism, those protections have been stripped away.
