Biden’s ATF Does The Worst Thing Possible For Gun Rights

President Biden’s target group of gun owners, which is by far the vast majority, have chosen to oppose the administration’s broad limitations on one of the most widely used and freely owned weapons ever produced. Only a tiny percentage of AR-15-style handgun owners have registered their weapons by the registration deadline of May 31 as required by the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF), which is expected to be between 0.6 percent and 1 percent. If they don’t, they might be punished severely under U.S.C. 586, which carries a maximum 10-year jail term, a $10,000 fine, or both. The ATF helpfully notes in the regulation that lying to a federal agency may also constitute a violation of 18 U.S.C. 1001, which carries a fine or a term of imprisonment for a maximum of five years, or both.

With no regular stock and a much shorter barrel than a normal rifle, AR pistols are guns of the AR-15 design. The pistol brace was created in 2012 by Alex Bosco to help a crippled veteran fire an AR-15 with greater accuracy. Later, he established SB Tactical as a business and collaborated with SIG Sauer to promote them. This restriction does not apply to pistol braces for handicapped shooters that fit the arm and do not function as a buttstock that may be carried like a rifle. An example of such a brace is a forearm brace.

The Biden administration decided to restrict them even though the ATF had previously said that AR-15-style handguns with arm braces were allowed. Republican Chair Jim Jordan addressed ATF Director Steven Dettelbach in an April hearing before the House Judiciary Committee as follows:

“You told them a particular thing ten years ago, and now you are telling them a completely different thing.”

Jordan continued by informing the organization that owners of the gun brace devices were becoming criminals overnight. Millions of braces must now be removed, registered, or discarded since the June 1 deadline has gone. Erik Longnecker, a spokesperson for the ATF, claims that as of June 1, 2023, the ATF had gotten 255,162 requests for tax-free registering. John Lott Jr., head of the Crime Prevention Research Center, notes that even if we take into account the average number of firearms in use:

“You are still talking approximately 29 million individuals who are currently technically breaking the law,”

Owners must now submit fingerprints as well as pay a $200 levy under the new rules. Until May 31, the ATF briefly waived the tax in an effort to promote registration. The vast majority of owners, however, have opted to take a risk in the hopes that the courts would reverse the ATF and Biden’s action, just like they did regarding the prohibition on “bump stocks” under the Trump administration.
